An Introductory Guide.
The following information is an overview to Canadian Labour / Employment Law; what you may be entitled to and some things to consider on how you can make the most of your notice or severance pay out.
An employer has the right to terminate your employment at any time without cause so long as they provide the appropriate notice and other applicable provisions prescribed by law.
There are guidelines under the Employment Standards Act (ESA) and there is Common Law. The ESA governs the minimum requirements an employer must provide to an employee in the circumstances of termination without cause. These are legal requirements and not negotiable or optional by the employer.
